THE SIGNAL

On April 3, 2025, the Office of Management and Budget issued memorandum M-25-21, Accelerating Federal Use of AI through Innovation, Governance, and Public Trust. It is direct about speed: “Agency policies must enable agency heads to delegate responsibilities and accountability for risk acceptance to appropriate officials throughout the agency, ensuring that swift action is possible with sufficient guardrails in place.” It also encourages assigning those responsibilities to officials who are accountable for the mission outcome of

the AI use case.

For high-impact AI, meaning AI whose output serves as a principal basis for decisions with a legal, material, binding, or significant effect on rights or safety, agencies had 365 days to document minimum risk management practices. Those include human oversight and timely human review or appeal for affected people.

BEFORE

Hypothetical: a benefits agency finishes its review of a tool that drafts eligibility case summaries. Privacy has signed. The program office has signed. The Chief AI Officer's team has documented that the use is not high-impact, because a caseworker makes every determination.

Then the file goes up for one more signature in the front office, where it waits behind the budget cycle. The file is ready. The person who can release it is not.

WHAT THE WAIT COSTS

Caseworkers keep the backlog. The pilot window closes. The next use case review joins the same queue, and the memo's intent, swift action with guardrails, never reaches the people doing the work.

AFTER

The agency writes the delegation down. Use cases with a documented not-high-impact determination are released by the official accountable for the mission outcome, with the Chief AI Officer informed.

High-impact use cases go to a named official with the minimum practices attached as evidence. Every release carries a name, a date and a reason, which is exactly what an accountability review will ask for.
